Lead-Based Paint Hazard Disclosure
Federal law (Residential Lead-Based Paint Hazard Reduction Act of 1992) requires sellers of homes built before 1978 to disclose any known lead-based paint or lead hazards and provide buyers with the EPA’s lead hazard information pamphlet. Buyers must also be given a 10-day opportunity to conduct a lead paint inspection or waive that right.
Fair Housing Act (No Discriminatory Advertising)
Under the federal Fair Housing Act, sellers (and their agents) must not publish any advertisement for the listing that expresses a discriminatory preference based on protected classes (e.g. race, color, religion, sex, disability, familial status, or national origin). For example, statements such as 'no children' or other exclusions in home listings are unlawful.
State-Level Rules Sellers Must Follow
Residential Real Property Disclosures (Material Facts & Radon)
Minnesota law (Minn. Stat. §§513.52–513.60) requires sellers to disclose **in writing** all known material facts about the property that could adversely and significantly affect the buyer’s use or enjoyment of the property. Sellers usually fulfill this by completing the Minnesota Uniform Seller’s Property Disclosure Statement, which covers structural, mechanical, and environmental conditions. Alternatively, if a seller chooses not to disclose (other than mandatory items), Minnesota allows a seller to provide a written **"No Representation"** statement (meaning the seller makes no representations as to certain aspects, putting the risk on the buyer). Importantly, Minnesota also has a **Radon Awareness Act**: sellers must disclose any knowledge of radon levels in the home and whether a radon mitigation system is in place, and must provide the buyer with a state publication on radon risks. Furthermore, sellers must disclose if the property is in (or next to) a former landfill or other contamination site, and whether there are any known methamphetamine lab contamination (if not cleaned up to state standards).
County & City Considerations
Local Truth-in-Housing Inspections
Several cities in Minnesota (including Minneapolis and Saint Paul) have **Truth-in-Sale of Housing** or **Truth-in-Housing** inspection ordinances. In Minneapolis, for example, a seller must have the home professionally evaluated and issue a Truth-in-Sale of Housing report **before** the home can be shown to buyers. The report (which grades certain conditions of the property) must be made available to prospective buyers. St. Paul has a similar requirement (TISH report). These city-required inspection reports are a form of disclosure to buyers about the basic condition of the home’s components. Some other MN cities (like Bloomington, Richfield, etc.) have their own point-of-sale inspection and disclosure requirements, especially for older housing stock. Sellers should check city requirements; failure to comply can result in fines or delays in sale (e.g., an unresolved TISH report item might have to be escrowed for repair).
