  • Residential Real Property Disclosures (Material Facts & Radon)

    Minnesota law (Minn. Stat. §§513.52–513.60) requires sellers to disclose **in writing** all known material facts about the property that could adversely and significantly affect the buyer’s use or enjoyment of the property. Sellers usually fulfill this by completing the Minnesota Uniform Seller’s Property Disclosure Statement, which covers structural, mechanical, and environmental conditions. Alternatively, if a seller chooses not to disclose (other than mandatory items), Minnesota allows a seller to provide a written **"No Representation"** statement (meaning the seller makes no representations as to certain aspects, putting the risk on the buyer). Importantly, Minnesota also has a **Radon Awareness Act**: sellers must disclose any knowledge of radon levels in the home and whether a radon mitigation system is in place, and must provide the buyer with a state publication on radon risks. Furthermore, sellers must disclose if the property is in (or next to) a former landfill or other contamination site, and whether there are any known methamphetamine lab contamination (if not cleaned up to state standards).

    Minnesota’s primary MLS (NorthstarMLS) requires a listing agreement. Listings must be entered within 2 business days of the effective date or start of marketing, per Clear Cooperation. NorthstarMLS requires at least one photo on each listing (and if the home is under construction, a rendering or plat map). Agents typically upload city Truth-in-Housing reports as supplements to the MLS listing for buyers’ agents. MLS remarks are policed for fair housing compliance. In Minnesota, MLS data feeds also include fields for disclosing if the seller is aware of environmental issues (like "Private well: Yes/No" or "Perc test: Yes/No"); however, these are not a substitute for the seller’s own required disclosure form. The MLS will fine for inaccurate information (e.g., mis-stating the number of bedrooms) or for failing to update a status change promptly.

    Under the federal Fair Housing Act, sellers (and their agents) must not publish any advertisement for the listing that expresses a discriminatory preference based on protected classes (e.g. race, color, religion, sex, disability, familial status, or national origin). For example, statements such as 'no children' or other exclusions in home listings are unlawful.
