Seller Disclosure Act
Michigan’s Seller Disclosure Act (Act 92 of 1993, MCL 565.951 et seq.) requires sellers of 1–4 unit residential properties to deliver a written Seller’s Disclosure Statement to the buyer before execution of a binding purchase agreement. Michigan’s disclosure form is specified by statute and includes the condition of the roof, basement (any leaks?), well/septic or other water system issues, environmental problems (like presence of radon, asbestos, underground storage tanks), pest infestations, structural and mechanical conditions, and more. Sellers must update the disclosure if something changes before closing. If a seller fails to provide the disclosure as required, the buyer can terminate the purchase contract before closing. Note: Michigan’s form does instruct sellers to disclose known lead-based paint (though federal law separately mandates lead disclosure). Certain transfers are exempt (estate sales, foreclosure sales by lenders, etc.).

MLS Rules (Realcomp and Others)
Michigan’s largest MLS, Realcomp II Ltd., along with others (like MiRealSource), require a listing agreement and full property data entry. The Clear Cooperation policy is followed. Realcomp requires at least one photo on each listing. Michigan MLS listings often indicate if the seller’s disclosure statement and lead paint form are available (often uploading them as attachments for buyer agents). As always, remarks cannot include language violating civil rights/fair housing laws. Also, Michigan being a "buyer beware" state aside from the disclosure form, MLS remarks commonly still say "all measurements approx., buyer to verify" but that’s a different issue of accuracy, not a disclosure. The MLS will sanction false information and enforce timely status updates.

Lead-Based Paint Hazard Disclosure
Federal law (Residential Lead-Based Paint Hazard Reduction Act of 1992) requires sellers of homes built before 1978 to disclose any known lead-based paint or lead hazards and provide buyers with the EPA’s lead hazard information pamphlet. Buyers must also be given a 10-day opportunity to conduct a lead paint inspection or waive that right.
Fair Housing Act (No Discriminatory Advertising)
Under the federal Fair Housing Act, sellers (and their agents) must not publish any advertisement for the listing that expresses a discriminatory preference based on protected classes (e.g. race, color, religion, sex, disability, familial status, or national origin). For example, statements such as 'no children' or other exclusions in home listings are unlawful.
