Sellers must **complete and deliver** a property disclosure form answering questions about the condition of the property’s structure and systems. The Idaho Real Estate Commission provides a standard form covering roof, basement, HVAC, water, sewer/septic, electrical, etc. Certain transfers (like new construction or foreclosure sales) are exempt. Sellers who fail to provide the disclosure can be liable for actual damages. Notably, Idaho’s form asks about knowledge of environmental hazards like lead-based paint, radon, or past meth lab use.
