  • Seller’s Disclosure (No State Form, But Specific Hazards Must Be Disclosed)

    Missouri does not mandate a standard seller disclosure form for property condition by law (though many sellers complete one as a courtesy). Nonetheless, Missouri sellers are obligated under common law to disclose known material defects that are not readily observable to the buyer to avoid fraud claims. Additionally, Missouri has statutes requiring disclosure of particular issues: If the seller **knows** the property was ever used as a methamphetamine lab (and has not been remediated per state guidelines), they **must disclose** that in writing to the buyer. Sellers also must disclose if the property is located in a Special Flood Hazard Area (floodplain) and whether the seller carried flood insurance. Missouri law explicitly states sellers are not required to disclose that a property was the site of a death, homicide or had an HIV-positive occupant (these are not considered material facts). However, sellers cannot lie if asked directly about such matters. Missouri REALTORS® provides a standard disclosure form that most sellers use, covering all basic property aspects, even if not legally required.

    In Missouri, listing on MLS (e.g., MARIS in St. Louis or Heartland MLS in Kansas City) requires a listing agreement. MLS rules apply Clear Cooperation (1 business day to list if publicly advertised). MLS rules also often require that the listing indicate if any disclosures are available. For instance, MARIS MLS has fields for disclosing known environmental hazards or if a disclosure form is on file. A photo is required. Any 'broker comments' in MLS might mention if the property is being sold as-is and if an occupancy permit is required from the city (alerting buyer agents). Missouri MLSs will fine non-compliance, like not updating a contingent sale or including branding in photos. Remarks cannot say anything like 'ideal for Christians' or other illegal preference (which is rarely an issue in remarks). Typically, agents in Missouri upload the seller’s disclosure form as a PDF attachment in MLS for buyers’ agents to review, even though it’s not legally mandated – it’s expected in practice for transparency.

    Federal law (Residential Lead-Based Paint Hazard Reduction Act of 1992) requires sellers of homes built before 1978 to disclose any known lead-based paint or lead hazards and provide buyers with the EPA’s lead hazard information pamphlet. Buyers must also be given a 10-day opportunity to conduct a lead paint inspection or waive that right.

  • Fair Housing Act (No Discriminatory Advertising)

    Under the federal Fair Housing Act, sellers (and their agents) must not publish any advertisement for the listing that expresses a discriminatory preference based on protected classes (e.g. race, color, religion, sex, disability, familial status, or national origin). For example, statements such as 'no children' or other exclusions in home listings are unlawful.
